A top court yesterday ruled a customer who demanded his money be returned for a four-wheel drive jeep that made “sounds of birds' chirping” when the engine passed 2,000 rpm was right.
Burak Berberoğlu from Antalya on the Mediterranean coast purchased a YTL 63,000 jeep in 2005 for his wife. It was soon revealed that a “chirping sound” came from the engine of the car. At first, technicians said there was nothing wrong with the car before deciding to replace the turbo engine to get rid of the sound. When that failed to solve the problem, Berberoğlu demanded a replacement, which the company refused, arguing that there was no problem with the car. He then demanded his money back, which was also rejected.
The matter went to the consumer rights court, where an expert said the car had “secret defects” in its engine and other components. The court ordered the company to return Berberoğlu's money.
The matter then went to the Supreme Court of Appeals' 13th Bureau, which also unanimously agreed to back the decision of the local court, ordering the company to return the YTL 63,000 with its legal interest. Berberoğlu's lawyer said the decision will set a precedent, adding, “A company that finds it normal for chirping sounds to come out of a car is unacceptable.”
